1. Acceptance of these Terms

These Terms and Conditions, together with our Privacy Policy, Refund Policy and Risk Disclaimer (collectively, the “Terms”), form a binding agreement between PropFundDesk (“Website Owner”, “we”, “us” or “our”) and you (“you” or “your”). They govern your use of propfunddesk.com, our applications and every service offered through them (the “Services”).

By creating an account, purchasing a plan or otherwise using the Services, you confirm that you have read and accepted these Terms. If you do not agree, do not use the Platform.

2. Eligibility

• You must be at least 18 years of age to register.
• You must be legally able to enter into a contract under the laws that apply to you.
• Payouts are made only to Indian bank accounts in Indian Rupees, so you must be an Indian resident where our program terms require it.
• You may not use the Services if doing so is prohibited in your location.

3. Your account and KYC

• You agree to give us true, accurate and complete information when you register and to keep it up to date.
• You are responsible for keeping your login details secret and for everything done through your account.
• Before your first payout you must complete KYC by submitting valid identity and bank documents (such as PAN, Aadhaar and bank proof). Payouts stay on hold until verification is complete.
• We may suspend or close an account if the information provided is false, incomplete or cannot be verified.

4. Evaluation programs and rules

PropFundDesk offers Instant, 1-Step and 2-Step programs. Each plan has its own account size, profit target, daily loss limit, maximum drawdown, minimum trading days, consistency rule, profit split and payout cycle. These figures are shown on the plan card and in your dashboard, and they form part of these Terms for that plan.

• Indian index derivatives can be traded during Indian market hours, 9:15 AM to 3:30 PM IST, on Indian trading days. Crypto instruments trade 24x7, including weekends and Indian market holidays.
• Indian positions are intraday and are squared off automatically at 3:15 PM IST; overnight positions are not permitted on them. Crypto positions may be held across sessions, subject to the rules of your plan.
• Crypto instruments are quoted in US Dollars. Your account balance, the plan fee and every payout remain in Indian Rupees.
• Breaching any rule of your plan ends the evaluation or funded account immediately.
• We may correct simulated fills, prices or balances that were affected by a data error, and may void trades that clearly exploited such an error.

5. Fees and refunds

Plan fees are payable in Indian Rupees in advance. The fee is a service charge for access to the evaluation and is not a deposit or trading capital. It becomes non-refundable once your account is activated or you place your first trade. The limited situations in which a refund is available, and how to request one, are set out in our Refund Policy.

6. Simulated environment and no broking

Every trade on PropFundDesk is executed in a simulated environment. We are not a crypto exchange and hold no digital assets on your behalf. We do not route orders to NSE, BSE, any crypto exchange or any other venue, we do not hold client funds for trading, and we are not a stock broker, exchange, investment advisor or portfolio manager. PropFundDesk is not a SEBI-registered intermediary. We provide technology and evaluation services only, and nothing on the Platform is investment advice or a recommendation to trade.

7. Payouts

• Payouts are performance rewards made under the program terms, not a share of real market profits.
• You become eligible for a payout only after meeting all rules of your plan, including any minimum trading days and consistency requirements.
• The profit split and payout cycle are those stated on your plan card.
• KYC must be complete and the bank account must be in your own name before a payout is released.
• We may review your trading before approving a payout and may withhold or reverse a payout where we find a rule breach, prohibited conduct or a technical error.
• Any tax on amounts you receive is your responsibility.

9. Termination

We may suspend or close your account, void results and cancel pending payouts if you breach these Terms, engage in prohibited conduct, fail KYC, or if we are required to do so by law. You may close your account at any time by contacting support. Closure does not entitle you to a refund of fees already earned.

10. Intellectual property

The PropFundDesk name, logo, website, dashboard, content and software belong to us or our licensors. You receive a limited, personal, non-transferable licence to use the Platform for your own evaluation. You may not copy, resell, modify or create derivative works from any part of the Services without written permission.

11. Limitation of liability

The Services are provided on an “as is” basis. We do not warrant that the Platform will be uninterrupted, error-free or that any data feed will be accurate at all times. To the fullest extent permitted by law, our total liability to you for any claim arising from the Services is limited to the fee you paid for the plan concerned, and we are not liable for indirect, incidental or consequential losses, including lost payouts or lost opportunity. Neither party is liable for failure to perform caused by events beyond its reasonable control.

12. Responsible participation

Trading, even in simulation, can be stressful. Spend only money you can afford to lose on evaluation fees, take breaks from the screen, and step away after a difficult session. If trading is affecting your sleep, finances, relationships or wellbeing, please reach out to someone you trust or a qualified professional.

13. Governing law and jurisdiction

• These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.
• All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in G MAMIDADA, Andhra Pradesh.

14. Changes to these Terms

We may update these Terms from time to time. The date at the top of this page shows the latest version. If a change materially affects your plan, we will notify you by email or through the dashboard. Continued use of the Services after an update means you accept the revised Terms.
